An attorney would have initially drafted the deed conveying the lease of half the Stratford tithes to Shakespeare, before a clerk or scrivener engrossed the final copy. Such drafts would generally be in a large flowing hand with plenty of space left between the lines to accommodate any extra material or edits. Thirteen of the original fourteen pages (the last is now missing) of the draft of the assignment to Shakespeare survive. Several interlineations were made, together with a few deletions, which were incorporated into the final version. Scholars generally think that the draft is in Francis Collins’s hand, as he witnessed the assignment. He is not known to have acted for Shakespeare again until he assisted in the drafting of Shakespeare’s will in 1616, which he also witnessed; however, the generous bequest he then received indicates Collins was a trusted companion.
In the top left of the first page the date, July 24, 1605, is included in a later hand, followed by the letters “E.M.” for Edmond Malone, a Shakespearean scholar. As the draft itself is undated, this establishes that Malone must already have come across the finished document during his well-authenticated inspection of the Stratford Corporation archives in the 1790s. It would appear that R.B. Wheler, a local antiquary, subsequently removed the finished assignment, as it thereafter came down to us as part of his papers. However, the fact that the bond is still in the Corporation archives confirms that the assignment itself was also once there. That it did not remain in Shakespeare’s possession amongst his other title deeds is explained by the fact that by a deed of 1625 (BRU 8/17/18), John Hall and his wife, Shakespeare’s daughter, surrendered the lease to the Corporation, together with the bond of £80.
It is less easy to explain why the draft is in the borough archives, as the Corporation was not directly involved in the transaction. However, this could have come about through the involvement of another attorney close to Shakespeare, Thomas Greene. He was also the town steward, or town clerk, and many of his papers remained in the Corporation archives when he sold up and left the town in 1617. Perhaps it was thought that he should not be too closely involved in this transaction, as the Corporation was generally ill-disposed towards the long leases of its tithes which were undermining the income they believed themselves rightfully entitled to.
